How Do I Get a Divorce in California?

If you decide to begin divorce proceedings in California, you will need to file a divorce petition. In order to do so, at least one of the spouses must have been a California resident for at least six months before filing the petition. Additionally, that spouse must have lived in the county for at least three months before filing the petition. The petition for divorce allows the court to have some basic information about your marriage, your children, and the orders you want the court to make (e.g., orders for property division, support, and custody). If you do not meet the residency requirements for divorce, you can still file for a legal separation, and you may still be able to obtain orders for custody and support.
